If they took it apart to evaluate it and then put it back together surely they would wind it and set the time as a matter of course and should have noticed the lack of minute hand, on the other hand no pun intended if they knew they'd dropped the hand and thought they could package it up and get you out of the shop as quick as possible then that is disturbing. It's a difficult thing to prove I guess, despite the common sense logic behind it.
