Any stop payment order of a check or any check returned to the AUCTION mark "insufficient Funds" or for any other reason marked "Refer to Maker" or "No Account, " or "Account Closed, " or the return of any draft unpaid, without valid reason, shall be deemed by all parties as prima facie evidence of fraud and intent to commit fraud existing at the time the transaction was consummated. Midland Odessa Auto Auction Guarantee the title to the vehicle described on this website to be free and clear of all liens and encumbrances at the time of this auction sale is executed to the PURCHASER for a period on ONE YEAR from the date hereof for the lesser of the following: i the purchase price as set forth hereon or ii the wholesale price of the vehicle at the time claim is filed: wholesale price to be determined by offering and selling said vehicle at auction. Upon Payment of any Guarantee of the title or check or draft on the hereon described vehicle, Midland Odessa Auto Auction or its assigns shall be, subrogated to all purchaser's rights of recovery thereof and PURCHASER shall use every reasonable means to secure and defend such rights so as to leave such rights intact and without prejudice. Seller and Purchaser each agree that should any vehicle be left on the premises of Midland Odessa Auto Auction for a period in excess to ten days. However, vehicles left after sales day are left at the owner's own risk. Midland Odessa Auto Auction makes no warranty of any kind, implied or expressed as to the year of manufacture or model of any foreign made vehicle. This includes frame damage, cracked blocks or any other defects.
