Barnes says those types of lawyers are subjected to more ethics complaints and bar investigations. Robert Barnes recently represented Karl Rittenhouse in a very public court trial. Karl, a 17 year old young man, was on trial for driving to Kenosha, Wisconsin and, in a street altercation where he was ambushed, shot and killed another man in the street in an act of self defense. Barnes explains that it was simple self defense. So that case is symbolic and emblematic of how the law and lawyers are needed even for the most innocent people to get even a little bit of justice in our system, and the system doesn't like that. The system wants to be able to control the outcomes so they try to rig who becomes lawyers and who becomes successful lawyers so ordinary people don't have an adequate defense in the court of law.

Barnes' father died when he was a child. He later attended Yale University for two years before transferring to the University of Tennessee at Chattanooga in , citing Yale's elitism as the reason behind his decision to switch schools. Barnes was formerly a partner at the Bernhoft Law Firm. Barnes represented Ralph Nader in a lawsuits regarding ballot access in Hawaii and Arizona for his presidential bid. While with Bernhoft in , Barnes served as one of actor Wesley Snipes ' criminal defense lawyers. After a federal trial, a jury acquitted Snipes of conspiracy and felony tax evasion but convicted him on three out of six counts of misdemeanor failure to file income tax returns.
